Terms of Service

These Terms of Service ("Terms") govern all purchases from and use of themcaleads.com (the "Site"). The Site and the products sold on it are owned and operated by Versatile Reserve LLC, doing business as The MCA Leads ("we," "us," "our"). By placing an order, starting a subscription, or submitting a request through the Site, you ("you," "Buyer") agree to these Terms.

1. What we sell

We sell business-lead data products — including full submission files, aged submission data, and SMS/email campaign data — to businesses such as MCA brokers, ISOs, funders and business loan brokers. All products are business-to-business. The Site and our products are not directed at consumers.

2. Orders and payment

  • All prices are in U.S. dollars. The price shown in the order builder at checkout is the price on your invoice.
  • Payment is due in full before leads are released. We accept Zelle, wire/ACH and Bitcoin. We do not accept credit or debit cards.
  • We may require you to sign a lead purchase agreement before delivery of an order or the start of a subscription.
  • All payments are made payable to Versatile Reserve LLC.
  • Orders are typically delivered within one (1) business day of cleared payment. Delivery times vary and may take up to five (5) business days.
  • Invoices generated on the Site are valid for 7 days.

3. Subscriptions

  • Monthly plans are billed by automatic ACH withdrawal under a subscription agreement and ACH authorization you sign at signup.
  • Plans carry a four (4) month minimum commitment. After the minimum, plans continue month to month and may be changed or cancelled with notice before the next billing date.
  • Monthly lead volumes are approximate and delivered on the schedule agreed with your account contact.

4. Delivery, replacements and no refunds

  • Leads are delivered digitally by Excel, CSV or both, or by another method agreed in writing. Delivery is typically within one (1) business day of cleared payment but may take up to five (5) business days.
  • Any record delivered without a working phone number will be replaced free of charge if reported within seventy-two (72) hours of delivery.
  • All sales are final. We do not offer refunds. Because lead data is a digital product that cannot be returned, replacement of defective records as described above is the exclusive remedy.

5. Exclusivity and license

  • Leads sold as exclusive carry a thirty (30) day exclusivity period from the date of delivery. During that period we will not resell those records. After the exclusivity period ends, records may return to our general inventory.
  • Leads are licensed to the purchasing company only, for its own business use. You may not resell, redistribute, share, or license the data to any third party.
  • We remain the owner of the data; your purchase grants a license to use it, not ownership of it.

6. Your compliance responsibilities

You are solely responsible for using purchased data in compliance with all applicable laws and regulations, including without limitation the Telephone Consumer Protection Act (TCPA), federal and state Do-Not-Call rules, the CAN-SPAM Act, state telemarketing and privacy laws, and any industry rules that apply to your business. You are responsible for obtaining any consents your outreach methods require and for maintaining your own suppression lists. We are not responsible for how you contact the individuals or businesses in the data.

7. No guarantee of results

Leads are business prospects, not customers. We do not guarantee contact rates, response rates, closings, fundings, revenue, or any particular business outcome. Descriptions of lead age, revenue tier and data fields describe the data as collected; business information is self-reported by merchants and may change after collection.

8. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or related to any order or subscription is limited to the amount you paid us for that order or, for subscriptions, the amount paid in the month in which the claim arose. We are not liable for indirect, incidental, consequential, special or punitive damages, or for lost profits.

9. Indemnification

You agree to indemnify and hold harmless Versatile Reserve LLC, its owners, employees and agents from any claims, damages, fines or expenses (including reasonable attorneys' fees) arising from your use of purchased data, including any alleged violation of telemarketing, messaging or privacy laws.

10. Changes to these Terms

We may update these Terms from time to time. The version posted on the Site at the time you place an order governs that order.

11. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Florida.
